The interdepartmental coordination of the bill of the Ministry of Agriculture on the turnover of agricultural land has been completed, the press service of the Ministry of Agriculture of Russia reports.
At present, the strategic task of the Russian agro-industrial complex is to increase production volumes, which, among other things, requires an increase in the area of effectively used agricultural land. In this regard, the Ministry of Agriculture of Russia is working to improve the legal regulation of the procedure for the withdrawal of unused agricultural land.
Thus, in order to reduce the time for the alienation of such land plots, the Ministry developed a draft federal law “On Amendments to the Federal Law “On the Turnover of Agricultural Land” and the Federal Law “On State Registration of Real Estate” on the issue of improving the procedure for the alienation of an agricultural land plot when such a land plot for its intended purpose or use in violation of the legislation of the Russian Federation.
The provisions of the draft law are aimed at reducing the actual term for the forced alienation of land plots from the composition of agricultural land from their owners in connection with the establishment of the fact of non-use of such land plots for three years, not from the moment of checking and fixing the existing long-term non-use, as it is provided now, but on the time of the control oversight. If trees and shrubs have already grown on a land plot related to agricultural land, then a violation of land legislation is obvious and it is not necessary to fix it for another 3 years, allowing further deterioration of the soil condition on such a plot.
The bill provides for the establishment for the owner of a land plot who has been issued an order on a violation of the legislation of the Russian Federation, a ban on registering the transfer of ownership of such a land plot with making a corresponding entry in the USRN until the violation is eliminated. This will make it possible to interrupt the chain of fictitious change of ownership only to evade responsibility for violation of land legislation.
The draft law also provides for the features of the sale of a land plot alienated from the owner at public auction through a public offer, which will simplify and speed up the sale of the site and the possibility of its acquisition by a bona fide user who wants to engage in agricultural production.
At present, the draft law has been approved by the interested federal executive authorities, and also approved by the working groups under the subcommittee of the Government Commission on Administrative Reform.
